Dear Mr. Trudell:
This is in reference to the administrative tort claim you filed in the amount of $724,099.92 in connection with an incident on May 31, 2013. After careful review of all the evidence in this case, it is my decision to deny your claim for the reasons set forth below.
Any recovery under the Federal Tort Claims Act must be predicated upon the negligent or wrongful act or omission of the part of a government employee acting within the scope of federal employment. See generally, 28 U.S.C. 2671, et seq. In this case, you failed to establish any negligent or wrongful act or omission on the part of any federal employee. You have also failed to substantiate the nature and extent of injuries, or the amount of alleged damages. See 28 C.F.R. 14.4(c). As such, the claim must be denied in its entirety.
Please be advised that if you are dissatisfied with this decision, you may file suit in an appropriate United States District Court no later than six months after the date of the mailing of this notification
