Description
In 1987, Luana was a juror in a murder trial for the death of a French tourist who was punched while leaving a restaurant in Times Square, New York City and died.
Although there was conflicting evidence, Luana said she was swayed by testimony from a witness who placed the two teenage defendants at the scene.
“It was hard to get past somebody who was one of their peers, to stand in court and say that they were there — and that he did it and he saw it.”
The jury was first split seven-to-four, and then 11-to-one with one juror holding out, believing the pair were innocent. Ultimately, the jury found them guilty, and both served more than 20 years in prison.
But years later, a letter from that witness changed everything.
Is the jury system the best way of deciding whether a person is guilty of a crime? To learn more about how Australia’s jury system is faring, watch Insight episode Beyond Reasonable Doubt on SBS On Demand.
