In a controversial judgment, the Chhattisgarh High Court ruled in Vasudev Gond vs State that placing the male organ on the vagina and ejaculating without penetration does not amount to rape under Section 375 of the IPC, but qualifies as an attempt to rape under Section 376/511. Justice Narendra Kumar Vyas observed that penetration is the essential ingredient of rape, and in the absence of proof of penetration, the conviction must be altered. As a result, the sentence was reduced from seven years to three-and-a-half years. The case dates back to 2004 and has reignited a nationwide debate on how rape is legally defined and interpreted in India. In contrast, the Supreme Court of India previously overturned a controversial verdict of the Allahabad High Court, which had ruled that breaking the drawstring of a minor’s pyjamas and touching her breasts did not amount to an attempt to rape. The Supreme Court stressed the need for greater judicial sensitivity in sexual assault cases.
