In this week’s edition of Facing South Florida: CBS News Miami's Jim Defede brings an important update on the ongoing saga of the Miami Center for Mental Health & Recovery. The facility took a big step toward finally opening after two years and $50 million in renovations following a Miami-Dade County commission meeting. At that meeting, it became clear that the majority of commissioners support opening the facility, which could provide treatment and help for hundreds of Miami-Dade’s mentally ill people. “Listen, we have a decreasing pot of money in the general revenue. And unfortunately, we will have to make the hard choices, District 5 commissioner Vicki Lopez said. “And for me, it will always be people over buildings and then those people vulnerable over not so vulnerable. This is for vulnerable people.” However, two commissioners remain opposed to opening the center – District 8 commissioner Danielle Cohen Higgins and commission chairman Anthony Rodriguez. Rodriguez remains the biggest obstacle to the center finally opening its doors. Until he places it on the official agenda, it can’t go for a full vote before the board. Despite commissioner Raquel Regalado asking to have it advanced to the next scheduled county commission meeting, Rodriguez refused to commit to doing so, saying, “I will take everything I heard under advisement and see how we move forward.” Also, Defede talks with historian Marvin Dunn, who joined several other Florida residents in a lawsuit involving the proposed Trump Presidential Library in downtown Miami. Dunn and the other plaintiffs want to block the transfer of land next to the historic Freedom Tower, saying doing so would violate the U.S. Constitution’s emoluments clause, because it states a president can’t receive a gift from the state. “And this is a gift from a state. This is a very valuable gift from the state,” says attorney Jerry Greenberg, who’s representing Dunn. “I don't think that the framers envisioned that 300 plus million dollar property across from a basketball arena in a commercial district, but that's what this is. It's a gift to the president, quite clear, quite simply. And what we're seeking to do is two things. We're seeking two things, we're seeing a declaration from the court that this is an unconstitutional emolument and we're an injunction to stop.
