Under federal law, my legal status grants me the right to work, obtain a Social Security Number, and be lawfully employed and taxed. Within this scope, I am also eligible to obtain and use a Commercial Driver’s License (CDL). However, under the current policy of “Non-Domiciled CDL,” individuals who are not U.S. citizens are issued CDL licenses that are limited strictly to the duration of their work authorization. This policy results in situations where legally authorized drivers lose their ability to work temporarily due to administrative delays or renewal processes of their work permits. This effectively restricts the right to work and earn a livelihood for individuals who are lawfully present in the country. I believe that this practice conflicts with fundamental human rights and the principle of equa lity. Because: 1. Under the Equal Employment Opportunity principle, no person who is lawfully authorized to perform a job should be discriminated against based on citizenship or immigration st atus. 2. The right to work is a fundamental human right protected under both the Equal Protection Clause of the U.S. Constitution and Article 23 of the Universal Declaration of Human Ri ghts. 3. Limiting the CDL validity period solely to the EAD duration effectively causes job insecurity and economic instability for individuals who are otherwise legally permitted to work, violating the principle of fair and equal opportunity. My request is as follows: That the federal and/or state-level regulations regarding “non-domiciled CDL” be revised to ensure that EAD holders retain their CDL privileges continuously as long as their legal work authorization remains valid. Specifically, I request that EAD holders be granted CDL validity equal to that of U.S. citizens or, at minimum, be provided a temporary CDL extension during EAD renewal processing to prevent employment disruption.
